(ITC) ha dictado una resoluci\u00f3n preliminar sobre el litigio que enfrenta en EE.UU. a los dos fabricantes surcoreanos de bater\u00edas LG Chem y SK Innovation. La ITC ha fallado a favor de LG Chem y se espera una decisi\u00f3n definitiva para el 5 de octubre.<!--more--><\/p>\n<p style=\"text-align: center;\"><em>++ A continuaci\u00f3n encontrar\u00e1 las actualizaciones. ++<\/em><\/p>\n<p>La demanda en cuesti\u00f3n hab\u00eda sido presentada por LG Chem en el <a href=\"https:\/\/www.electrive.com\/es\/2019\/04\/30\/ee-uu-lg-chem-presenta-demandas-contra-sk-innovation\/\">principios de 2019<\/a> contra SK Innovation en EE.UU. Sin embargo, la disputa se remonta a finales de 2016, cuando SK Innovation caz\u00f3 furtivamente a 77 empleados de LG Chem, un \"n\u00famero significativo\" de ingenieros, acusados posteriormente de haber transmitido supuestamente a SK Innovation los conocimientos t\u00e9cnicos protegidos de LG Chem en el desarrollo y la fabricaci\u00f3n de c\u00e9lulas de iones de litio en bolsa. <a href=\"https:\/\/www.electrive.com\/es\/2019\/09\/02\/la-carne-de-vacuno-en-bateria-sigue-aumentando\/\">A finales de 2019,<\/a> SK Innovation dio la vuelta a la tortilla e inici\u00f3 una contrademanda por infracci\u00f3n de patentes.<\/p>\n<p>En diciembre, archivos judiciales estadounidenses examinados por <em>Reuters<\/em> demostr\u00f3 que ambas empresas intentaban impedir mutuamente la importaci\u00f3n y venta de bater\u00edas destinadas a los todoterrenos el\u00e9ctricos de Volkswagen y Ford en EE.UU., entre otros. LG Chem aleg\u00f3 que SK Innovation obtuvo el contrato de suministro de celdas de bater\u00eda para el MEB de Volkswagen s\u00f3lo porque empleados contratados por LG Chem supuestamente revelaron dichos secretos comerciales.<\/p>\n<p>La disputa tiene en vilo a los gobiernos y a los gigantes internacionales de la automoci\u00f3n. El gobierno surcoreano se dirigi\u00f3 a ambas empresas suplicando una soluci\u00f3n al desacuerdo que amenaza con interrumpir el suministro de bater\u00edas tanto a Volkswagen como a Ford en EE UU. <a href=\"https:\/\/www.electrive.com\/es\/2019\/12\/03\/unidos-resistiremos-divididos-caeremos\/\">A finales del a\u00f1o pasado<\/a>, el ministro de Industria, Sung Yoon-mo, declar\u00f3 que segu\u00edan de cerca la disputa, con el deseo de apoyar una y que produjera un \"resultado positivo para el pa\u00eds en general\". However, we won&#8217;t nail down our decision. We are also open to talking with SK Innovation for a possible settlement.&#8221;  <\/p>\n<p>It seems that SK Innovation is similarly open to talks, saying that LG Chem is still its &#8220;business partner to develop the battery industry&#8217;s ecosystem together,&#8221; which would indicate an inclination to move beyond the corporate war zone.<\/p>\n<p>According to <em>The Korean Times<\/em>, an analyst from the Korean battery industry said that &#8220;Both LG Chem and SKI want to reach a settlement ending their long legal tussle because neither of them wants to lose their customers, which are EV makers.&#8221;<\/p>\n<p>But, if the final decision of the US Trade Commission follows the preliminary one, this could mean that SK Innovation will not be allowed to import the battery components into the US required to supply the US factories for Volkswagen and Ford Motors.<\/p>\n<p><strong>Update 21 July 2020<\/strong>: Volkswagen and Ford have now jointly renewed their appeal to the United States International Trade Commission (ITC) to allow SK Innovation to manufacture batteries at its proposed factory in Georgia. <\/p>\n<p>Volkswagen fears that a &#8220;catastrophic supply disruption&#8221; would be imminent if the case is not laid to rest. Ford emphasised that LG Chem&#8217;s assertion that it can replace SK Innovation as a supplier is not &#8220;credible&#8221; citing existing EV battery supply shortages and the long development period for EVs. The US carmaker also pointed to possible job losses should no agreement be reached.<\/p>\n<p>As before, LG Chem declined to comment, citing ongoing litigation, reports <em>Reuters<\/em>.
