Despu\u00e9s de un decisi\u00f3n prejudicial a favor de LG Chem<\/a> en EE.UU. sobre la disputa legal entre los fabricantes surcoreanos de bater\u00edas LG Chem y SK Innovation, la disputa legal entre ambas empresas continu\u00f3 en Corea del Sur - y se ha dictado sentencia. <\/p>\n

Aqu\u00ed SK Innovation parece haber sacado de nuevo la pajita m\u00e1s corta: en esta disputa de patentes relacionada, el Tribunal de Justicia de Se\u00fal tambi\u00e9n ha fallado ahora a favor de LG Chem. SK Innovation ha dicho que recurrir\u00e1 la decisi\u00f3n.<\/p>\n

De vuelta a EE.UU., si la ITC mantiene su fallo preliminar de febrero, las cosas podr\u00edan ponerse dif\u00edciles en el lado del suministro de bater\u00edas para los fabricantes de veh\u00edculos. SK Innovation no podr\u00e1 exportar bater\u00edas para veh\u00edculos el\u00e9ctricos ni equipos de fabricaci\u00f3n a Estados Unidos. Una noticia nefasta, sin duda, ya que SK Innovation ha dos plantas de bater\u00edas en EE.UU., una de ellas en construcci\u00f3n<\/a> en Georgia.<\/p>\n

Parece que ambas partes est\u00e1n bastante enconadas a pesar de la insistencia tanto del gobierno coreano como de los fabricantes de veh\u00edculos de EE.UU. para resolver la disputa de una forma que permita a todos seguir con sus negocios. The Korean news outlet wrote that SK finished its Thursday statement with the sentiment that the company \u201chopes to continue cooperation for the battery industry\u2019s growth.\u201d Showing a pretty hard line, LG Chem’s statement said that it intends to \u201cpush through all legal procedures to the very end if SK Innovation does not show sincerity.\u201d<\/p>\n

In July just passed we reported that Volkswagen and Ford jointly renewed their appeal to the United States International Trade Commission (ITC) to allow SK Innovation to manufacture batteries at its proposed factory in Georgia.<\/p>\n

Volkswagen fears that a \u201ccatastrophic supply disruption\u201d would be imminent if the case is not laid to rest. For their part, Ford emphasised that LG Chem\u2019s assertion that it can replace SK Innovation as a supplier is not \u201ccredible\u201d citing existing EV battery supply shortages and the long development period for EVs. The US carmaker also pointed to possible job losses should no agreement be reached.<\/p>\n

The final decision with the ITC in the USA will be handed down in October. If SK Innovation indeed continues to challenge the ruling now made in Korea, this could go on for a while.<\/p>\n
