BYD, Stellantis, Tesla and Volkswagen: Italy dismisses investigations into customer deception
The investigations launched in February into potential unfair commercial practices focused on the automakers’ claims regarding the range of electric vehicles (EVs), battery capacity degradation, and limitations in battery warranties. The allegations centred on how the automakers communicated with their customers. For example, their websites were found to provide ‘generic and sometimes contradictory information’ about EV range without adequately clarifying which factors could significantly reduce the advertised maximum range.
The agreement to dismiss the proceedings now resolves these issues: the four companies have committed to revising their websites to present information more transparently to consumers, according to the regulatory authority. They have also pledged to integrate a simulation tool on their websites, enabling consumers to compare vehicle ranges within a market segment. Additionally, the warranty terms related to battery ageing will be rewritten for clarity. The competition authority has accepted the manufacturers’ commitments and waived financial penalties.
The AGCM (Autorità Garante della Concorrenza e del Mercato) is Italy’s authority for antitrust matters and consumer rights protection. According to Reuters, violations can result in fines of between €5,000 and €10 million for companies.
